Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Mediabriz service ("Service") provided by CloudBriz Technologies Ltd. ("CloudBriz," "we," "us," or "our"), including the Mediabriz browser extension and associated cloud services.
By installing, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Your use of the Service is also governed by the Mediabriz End User License Agreement ("EULA"). In the event of any conflict between these Terms and the EULA, the EULA shall prevail.
1. Service Description
Mediabriz is a browser extension and cloud-based service that integrates with the Genesys Cloud platform to provide media file management and related capabilities for customer conversations. For a detailed description of the Software and its features, refer to the EULA.
The Service may also include administrative dashboards that present aggregate, organization-level usage analytics and reporting. Access to such dashboards is controlled by the permissions the Customer grants within Genesys Cloud.
Mediabriz is an independent product developed by CloudBriz Technologies Ltd. Mediabriz is not affiliated with, endorsed by, certified by, security-validated by, warranted by, or operated by Genesys. Listing within the Genesys AppFoundry marketplace, or use of Mediabriz alongside Genesys Cloud, does not constitute any endorsement, certification, security validation, warranty, or representation by Genesys as to the Service, its functionality, its security, or its fitness for any purpose.
1.1 License Grant
Subject to these Terms, the EULA, and your organization's active Mediabriz subscription, CloudBriz grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for your internal business use. All rights not expressly granted herein are reserved by CloudBriz.
2. Eligibility and Access
2.1 Requirements
To use the Service, you must:
- Hold a valid Genesys Cloud user account with appropriate permissions
- Have an active Mediabriz subscription obtained through the Genesys AppFoundry marketplace, a direct agreement with CloudBriz, or any other authorized channel
- Use a supported web browser, including Google Chrome or Microsoft Edge
CloudBriz does not guarantee compatibility with all browser versions, configurations, or environments. Functionality may vary depending on browser version, operating system, and network configuration.
2.2 Authentication and Account Responsibility
The Service authenticates users exclusively through Genesys Cloud OAuth. No separate Mediabriz account is created. Your access to the Service is tied to your Genesys Cloud credentials and your organization's subscription status.
You are responsible for maintaining the security of your credentials and for all activity that occurs under your account or through your organization's use of the Service, including actions taken by other authorized users within your organization.
2.3 Organization Configuration
Your organization's Genesys Cloud administrator is responsible for enabling and configuring the Mediabriz Service, including selecting the data region and enabling optional features such as Mediabriz Guard (media scanning).
3. Billing and Pricing
3.1 Metered Billing
The Service is billed through the Genesys AppFoundry marketplace using metered billing. Usage is measured and reported daily.
3.2 Base Usage
Base usage is billed per unique conversation presented in the Service. A conversation is counted the first time it is displayed to any user within your organization. Each unique conversation ID is recorded and retained for one (1) year. After the one-year retention period expires, the record is automatically deleted. If the same conversation is subsequently presented in the Service after its record has expired, it will be counted and billed as a new item.
3.3 Mediabriz Guard (Scanning Add-on)
If enabled for your organization, Mediabriz Guard provides media file scanning and is billed per unique file scanned. Each scan result is recorded and retained for one (1) year. After the one-year retention period expires, the scan record is automatically deleted. If the same file requires scanning after its record has expired, it will be scanned and billed as a new item.
3.4 Fair Usage
The Service is designed for standard business use within Genesys Cloud contact center operations. CloudBriz reserves the right to review usage patterns that significantly exceed normal operational levels, including but not limited to:
- Conversations containing an unreasonably high number of media files, including unusually large file sizes or excessive processing demands, that result in disproportionate scanning or processing charges
- Automated, scripted, or programmatic use of the Service that generates excessive API calls, scan requests, or data processing beyond what is typical for human agent interaction
- Any usage pattern that impairs the Service for other customers or places undue burden on the infrastructure
If CloudBriz identifies usage that it reasonably considers to exceed fair use, CloudBriz will notify your organization and work in good faith to resolve the matter. CloudBriz reserves the right to apply additional charges for excessive usage, throttle processing, or suspend the affected functionality if fair usage is not restored after reasonable notice.
3.5 Billing Disputes
Usage data is reported to the Genesys AppFoundry marketplace daily. If you believe there is a billing discrepancy, contact us at service@mediabriz.com within 30 days of the billing period in question. We retain billing records for a reasonable period as required for operational, legal, and dispute resolution purposes, typically no less than six (6) months.
4. Genesys Cloud API Usage
The Service makes API calls to Genesys Cloud on your behalf to retrieve conversation data, media files, and user information. These API calls are subject to the following:
- API calls made by the Service consume your organization's Genesys Cloud API rate limits and quotas
- Any charges imposed by Genesys Cloud for API usage, including overage fees, are your organization's responsibility
- CloudBriz is not liable for any costs, service degradation, or rate limiting resulting from Genesys Cloud API consumption by the Service
- The Service implements reasonable optimizations (caching, batching) to minimize API usage, but cannot guarantee specific consumption levels
5. Mediabriz Guard - Scanning Service
Mediabriz Guard is an optional add-on that provides media file scanning as a supplementary security measure. If your organization has enabled Mediabriz Guard, your use of the scanning functionality is subject to the terms, disclaimers, and limitations set forth in the EULA.
The Services are not intended to replace the Customer's own security controls, antivirus systems, endpoint protection, compliance procedures, legal review obligations, internal governance processes, data retention systems, employee training, or regulatory obligations. The Customer remains solely responsible for these matters and for determining how to act on, rely upon, or use any output of the Services, including scan results.
CloudBriz does not guarantee that the scanning service will detect all threats. The scanning service is not a substitute for your organization's existing endpoint security, antivirus, and cybersecurity measures. To the maximum extent permitted by applicable law, CloudBriz shall not be liable for any damages, losses, or costs arising from undetected malware, reliance on scan results, or actions taken or not taken based on scan results.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful, fraudulent, or prohibited purpose, or in violation of any applicable laws or regulations
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of any part of the Service
- Attempt to circumvent, disable, or bypass any security features, access controls, rate limits, or other restrictions of the Service
- Misuse, abuse, or exploit the Service, its features, or its resources in any manner inconsistent with its intended purpose
- Use the Service to transmit malicious software, introduce harmful code, or interfere with other users or their use of the Service
- Share your access credentials or allow unauthorized third parties to access the Service through your account
- Use the Service in a manner that could damage, disable, overburden, or impair the Service or its infrastructure
- Use automated means to access, scrape, or extract data from the Service beyond its intended functionality
7. Intellectual Property
The Service, including the browser extension, backend infrastructure, cloud services, and all associated documentation, is the proprietary property of CloudBriz Technologies Ltd. and is protected by copyright, trade secret, and other intellectual property laws. CloudBriz retains all right, title, and interest in and to the Service, including all intellectual property rights therein. No ownership, title, or intellectual property rights in the Service are transferred to you under these Terms.
The Mediabriz name, logo, and associated branding are trademarks of CloudBriz Technologies Ltd. Your use of the Service does not grant you any right to use CloudBriz's trademarks, service marks, or trade names without prior written consent. All rights not expressly granted in these Terms are reserved by CloudBriz.
8. Privacy and Data Protection
Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your data. For details on our security practices, see our Security Overview. If your organization requires a Data Processing Agreement, please refer to our DPA or contact us at service@mediabriz.com.
9. Third-Party Services
The Service depends on third-party platforms and services, including but not limited to Genesys Cloud, browser platforms (such as Google Chrome and Microsoft Edge), and cloud infrastructure providers. CloudBriz is not responsible for the availability, performance, changes, deprecations, or terms of these third-party services. Changes or disruptions by third-party providers may affect the availability or functionality of the Service without liability to CloudBriz. CloudBriz is not obligated to modify the Service to accommodate changes made by third-party providers. Your use of Genesys Cloud is governed by your agreement with Genesys.
To the maximum extent permitted by applicable law, CloudBriz shall not be liable for any failures, disruptions, data loss, or loss of functionality caused by third-party platforms, including Genesys Cloud, whether resulting from outages, API changes, platform modifications, or any other third-party action or omission.
9.1 Data Accuracy
The Service retrieves and displays data from Genesys Cloud, including conversation metadata, media files, and user information. CloudBriz does not independently verify the accuracy, completeness, or currency of data obtained from Genesys Cloud or any other third-party source. CloudBriz is not liable for any inaccuracies, errors, or omissions in data originating from third-party services.
10. User Content
10.1 Responsibility
The Customer retains sole responsibility for all media files, recordings, documents, attachments, images, audio, video, communications, annotations, follow-ups, and other content processed, uploaded, transmitted, displayed, stored, or accessed through the Service ("Customer Content"). CloudBriz does not monitor, review, validate, endorse, or pre-approve Customer Content and shall not be liable for the legality, accuracy, ownership, integrity, reliability, security, regulatory compliance, copyright status, confidentiality, or appropriateness of Customer Content. The Customer is solely responsible for ensuring that all Customer Content is processed lawfully and with all required consents, authorizations, and rights.
10.2 No Liability for User Content
CloudBriz shall not be liable for any claims, damages, or losses arising from the content created by users through the Service, including but not limited to defamatory, offensive, or inaccurate content. You agree to indemnify CloudBriz against any third-party claims arising from your user-generated content.
11. Service Availability and Suspension
11.1 Availability
CloudBriz does not guarantee any specific level of availability, uptime, or performance of the Service. No service level agreement (SLA) is provided unless separately agreed upon in writing. The Service may be subject to planned maintenance, unplanned outages, or interruptions due to factors including but not limited to third-party service dependencies, network issues, or infrastructure events. CloudBriz may modify, suspend, or discontinue any part of the Service at any time without prior notice and without liability. CloudBriz shall not be liable for any damages arising from service interruptions, modifications, or unavailability.
11.2 Suspension
CloudBriz may temporarily suspend access to the Service, in whole or in part, if necessary to:
- Protect the security or integrity of the Service or its infrastructure
- Prevent abuse or excessive usage that impairs the Service for other customers, including where usage exceeds reasonable limits during trial or evaluation periods
- Investigate suspected violations of these Terms
- Comply with legal or regulatory obligations
CloudBriz may suspend access without prior notice where it determines, in its sole judgment, that immediate action is necessary. CloudBriz shall not be liable for any damages arising from such suspension.
11.3 No Compliance or Archival System
The Service is not intended to serve as a system of record, compliance archive, or legal evidence repository. Customers remain solely responsible for maintaining their own records and compliance systems as required by applicable law or regulation.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
CLOUDBRIZ DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. CLOUDBRIZ DOES NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT ACCESSED THROUGH THE SERVICE.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CLOUDBRIZ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CLOUDBRIZ SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM OR RELATED TO MALWARE, RANSOMWARE, PHISHING ATTACKS, UNAUTHORIZED ACCESS, DATA EXPOSURE, FILE CORRUPTION, MISSED DETECTIONS, FALSE POSITIVES, FALSE NEGATIVES, BUSINESS INTERRUPTION, GENESYS CLOUD OR OTHER THIRD-PARTY API CONSUMPTION CHARGES, THIRD-PARTY PLATFORM FAILURES, OR SECURITY INCIDENTS, REGARDLESS OF THE LEGAL THEORY UPON WHICH THE CLAIM IS BASED.
CLOUDBRIZ'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL FEES PAID BY YOUR ORGANIZATION FOR THE SERVICE DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
14. Assumption of Risk
You acknowledge and agree that:
- The Service operates over the internet and depends on third-party infrastructure, which may be subject to interruptions, latency, and security vulnerabilities beyond CloudBriz's control
- Media files processed by the Service originate from third parties and may contain malicious content, regardless of any scanning performed
- The Service is a productivity tool and is not a substitute for professional security, compliance, or archival solutions
- You use the Service at your own risk
15. Indemnification
You agree to indemnify, defend, and hold harmless CloudBriz and its officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees and costs) arising out of or related to:
- Your use of the Service, including any use by other individuals accessing the Service through your organization's account
- Your violation of these Terms or any applicable law or regulation
- Your violation of any rights of a third party
- Any content you create, upload, or share through the Service
- Any claim that your use of the Service caused damage to a third party
16. Subscription Term and Termination
16.1 Subscription Term
Your use of the Service is governed by the subscription terms agreed upon between your organization and CloudBriz, whether through the Genesys AppFoundry marketplace or through a direct agreement with CloudBriz Technologies Ltd. Subscription terms may include monthly, annual, or other commitment periods as specified in your subscription agreement.
16.2 Termination by You
Your organization may terminate its subscription in accordance with the terms of its subscription agreement. Uninstalling the browser extension does not constitute cancellation of the subscription and does not relieve your organization of its payment obligations for the remainder of the committed subscription term. To terminate:
- Genesys AppFoundry subscriptions: Your organization's administrator must follow the cancellation process through the Genesys AppFoundry marketplace, subject to the commitment terms of the selected plan (e.g., monthly, annual)
- Direct agreements: Your organization must provide written notice to CloudBriz in accordance with the termination provisions of the direct agreement
16.3 No Refunds
Unless otherwise specified in your subscription agreement or required by applicable law, fees paid for any subscription period are non-refundable. Early termination does not entitle your organization to a refund of fees already paid or a waiver of fees due for the remaining commitment period.
16.4 By CloudBriz
CloudBriz may suspend or terminate your access to the Service, at its sole discretion, immediately and without prior notice, if:
- You or your organization violate these Terms or the EULA
- Your organization's subscription expires or is cancelled in accordance with Section 16.2
- Your organization fails to pay applicable fees
- CloudBriz determines, in its sole judgment, that continued access poses a risk to the Service, its infrastructure, or other customers
- CloudBriz is required to do so to comply with legal obligations
- Continued provision of the Service becomes commercially impracticable
CloudBriz shall not be liable for any damages, losses, or costs arising from the suspension or termination of your access under this section.
16.5 Effect of Termination
Upon termination or expiration of the subscription, your right to use the Service ceases immediately. You must uninstall the browser extension. Data is retained according to the schedules described in our Privacy Policy and then automatically deleted. Sections 1.1 (License Grant), 5 (Scanning Service), 7 (Intellectual Property), 10 (User Content), 12 (Disclaimer of Warranties), 13 (Limitation of Liability), 14 (Assumption of Risk), 15 (Indemnification), and 21 (Governing Law) survive termination.
17. Modifications to the Terms
CloudBriz may modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service.
18. Beta and Experimental Features
From time to time, CloudBriz may release experimental or beta features within the Service. Such features may be identified as "beta," "preview," or "experimental" and are provided for evaluation purposes only. Beta features may be modified, degraded, or discontinued at any time without prior notice and may not be subject to the same service levels, support, or liability protections as the standard Service. Use of beta features is at your own risk.
19. Force Majeure
CloudBriz shall not be liable for any failure or delay in performance of its obligations under these Terms to the extent such failure or delay results from circumstances beyond its reasonable control, including but not limited to: acts of God, natural disasters, pandemics, epidemics, war, terrorism, riots, government actions or orders, power or internet outages, telecommunications failures, cyberattacks, failures of third-party services (including Genesys Cloud, Amazon Web Services, the Chrome Web Store, and other browser extension marketplaces), labor disputes, or supply chain disruptions. During any such force majeure event, CloudBriz's obligations under these Terms are suspended for the duration of the event.
20. Class Action Waiver
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AND CLOUDBRIZ AGREE THAT ANY CLAIMS OR DISPUTES ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL BE BROUGHT SOLELY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING.
21. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Israel, without regard to conflict of law principles. The competent courts of Tel Aviv, Israel shall have exclusive jurisdiction over any dispute arising out of or related to these Terms, except where the parties have agreed otherwise in a signed written agreement.
22. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
23. Entire Agreement
These Terms, together with the EULA, Privacy Policy, and DPA (if applicable), constitute the entire agreement between you and CloudBriz regarding the Service. In the event of any conflict between these Terms and the EULA, the EULA shall prevail.
